Frisco Child Custody Attorney
I often use the term "custody" on this site because that is the term that most of my clients know when they first contact my office. Technically, the Texas Family Code does not use the term custody. Rather, the term utilized is conservatorship.
In Texas, the legislature and courts recognize that it is critically important for children to maintain a close relationship with both parents after a divorce. Except in cases involving special circumstances (e.g., domestic violence, chemical dependency or child abuse), the Texas Family Code favors that both parents have joint custody (conservatorship) of minor children.
Joint custody, however, does not necessarily mean an equal 50/50 visitation schedule (referred to as a possession schedule in Texas). The standard possession schedule calls for one parent to have the children the majority of the time, with the other parent having ample visitation time with the minor children that fosters a close parent-child relationship.
The standard possession schedule is just a starting point. I work closely with my clients to develop parenting plans that work for all parties involved, when possible.
